When an individual is charged with the crime of child abuse, certain elements must be proven by the state. Child abuse is physical injury of a child under the age of 18 caused by a parent or other person who has permanent or temporary custody, or responsibility for the supervision of the child.
In order to convict the defendant of child abuse, the state must prove:
- That the defendant is a family member of the child or was a member of the household, and that he or she had permanent or temporary care, custody, or responsibility for the supervision of the victim
- That the victim was under 18 years of age at the time of the abuse
- That the defendant caused physical injury as a result of cruel or inhumane treatment
- That the victim’s welfare was harmed or threatened as a result of the treatment
